THE GENERAL TERMS AND CONDITIONS OF SALE
Article 1 : Object
1.1 The purpose of these General Terms and Conditions is to define the rights and obligations of the parties in connection with the online sale of goods and products offered for sale by the Seller to the Customer.
1.2 The products marketed by hygiene-precision.com are intended for dental professionals and individuals. hygiene-precision.com cannot be held responsible for the negligent and/or unprofessional use of our products. Any person who violates these provisions will be prosecuted and liable for the damage to hygiene-precision.com as a result of this.
Article 2 : Application
2.1 These General Terms and Conditions of Sale apply to any order placed with the Seller. Any order implies the full and unreserved acceptance of the Customer to these General Terms and Conditions of Sale and its waiver of all other conditions. No particular condition can therefore, except formal and written acceptance by the Seller, prevail against these General Terms of Sale.
2.2 These General Terms and Conditions of Sale are communicated without delay to any buyer who requests it. In any case, the GCS can be consulted on www.hygiene-precision.com.
2.3 These GTC come into force on the date of validation of the order. Promotional offers with more favourable conditions than those mentioned herein are valid for the period indicated on the offer, at the expense of those who intend to return their response before the deadline mentioned.
2.4 hygiene-precision.com reserves the right to modify these General Terms and Conditions of Sale at any time. In this case, the applicable Terms will be those in force on the date of the order by the buyer.
Article 3 : General terms and conditions of hygiene-precision.com
3.1 The website www.hygiene-precision.com is for use by oral health professionals and individuals from metropolitan France, overseas departments and communities, Belgium and Switzerland. The customer is responsible for the information provided to hygiene-precision.com and undertakes to update it in case of change.
3.2 All texts, comments, illustrations and images reproduced or represented on the website www.hygiene-precision.com are strictly reserved for copyright as well as for intellectual property. Any reproduction of the entire or partial content of www.hygiene-precision.com is strictly prohibited.
3.3 Personal data: The information requested from the Customer is necessary for the processing and delivery of the order. The information collected is processed by computer to provide the Client with services and content.
3.4 Cookies: When visiting our website www.hygiene-precision.com, information may be stored in "Cookies" files installed on your computer, tablet or mobile phone. To help you understand what a cookie is, what it does and how it can be set, please visit the Privacy & Cookies page.
3.5 Right of access: In accordance with the law on data processing and freedoms no78-17 of 6 January 1978, as amended, you have a right to access, rectify and oppose personal data concerning you. Simply write us online at contact and tell us your name, first name, email address and if possible your customer reference.
Article 4 : Order
4.1 The validation of the order by the customer is deemed to be acceptance of these General Conditions of Sale hygiene-precision.com reserves the right to refuse an order. Orders are only valid after validation by www.hygiene-precision.com.
4.2 Any request by the customer to modify or cancel the order must be made in writing to contact BEFORE the order is shipped.
4.3 Any request by the customer to modify or cancel a special order will not be taken into account in any way, as the products are specially manufactured for this order. Thus, any special order validated by the customer is firm and definitive.
4.4 The products are offered for sale within the limits of available stocks. hygiene-precision.com cannot be held responsible for any stock shortages.
4.5 Depending on the delivery area selected during the order, some products may not be available.
4.6 The photographs or illustrations of products in the catalogue on www.hygiene-precision.com are not contractual, they are taken from the supplier catalogue and are offered as illustrations. These images do not constitute a contractual element or a source of complaint. The buyer must limit himself to the information indicated on the site in the details and characteristics of the products, which prevail over the images associated with these same products.
Article 5 : Price
5.1 The products are invoiced on the basis of the prices in force on the day of the order.
5.2 The price includes VAT.
5.3 hygiene-precision reserves the right to change its rates at any time and without notice, on the understanding that the price applicable to the Customer is the one in force on the day of the order.Article 6 : Delivery
6.1 Shipping costs will be charged for any order depending on the place of delivery and the items.
6.2 hygiene-precision reserves the right to add shipping costs for orders with a large volume, quantities and/or weight. If the quantities requested by the customer are considered to be exceptionally high compared with normal consumption of the item, hygiene-precision.com reserves the right not to serve all ordered units and/or change the sale price of the item. Any additional charges for these orders will be communicated prior to shipping.
6.3 Delivery will be made to the address indicated at the time of order.
6.4 The delivery time is 4-5 working days in metropolitan France, 6 to 18 days for an overseas destination and 5 to 8 days for Europe. Professional products requiring a longer processing time the delivery time will be increased by three days. However, in case of exceeding the delivery time, no damages will be due and the Customer will not be able to cancel the orders in progress. However, if 30 days after the indicative delivery date, the product is not delivered, for any reason other than a case of force majeure (any cause recognised as such by French case law and/or war, riot, fire, strikes, accidents, the impossibility for the Seller to be supplied itself are considered force majeure), the sale may then be cancelled at the request of either party. The Customer may obtain refunds of his deposit to the exclusion of any other compensation or damages. hygiene-precision will keep the Client informed, as soon as possible, of the occurrence of such circumstances. In any event, delivery on time can only be effected if the buyer is up to date with its obligations towards hygiene-precision , whatever the cause.
6.5 At the time of delivery, the customer is responsible for checking the condition of the packaging and products. It is the responsibility of the Customer to make any reservations and complaints that he deems necessary, or even to refuse the package when it is clearly damaged at the time of delivery. The customer must also ensure that the products delivered to him correspond to the order.
Article 7 : Warranty
7.1 All Aquolab machines are produced by EB2C srl and have a 2 year warranty. However, the warranty does not apply to defects resulting from accidents, negligence, improper use, failure to follow product instructions, limescale deposits, inadequate maintenance, normal wear and tear, use with incorrect tension (boats or motorhomes or countries with different networks), unauthorized modification of the product, fire, lightning, flood or other external causes.
7.2 If it is necessary to send your device to us for verification, repair or replacement, you are invited to contact hygiene-precision.com to activate the RMA procedure. You will be assigned an RMA (return authorization) number and a form to be attached to your shipment with instructions.
7.3 To benefit from the warranty, the customer must provide proof of the date of purchase and delivery of the goods. It is therefore important, for the purposes of this proof, to keep the purchase invoice or order confirmation. These documents will be essential to request repairs of any kind to be carried out free of charge under warranty.
Article 8 : Invoicing
8.1 Each delivery corresponds to an invoice that is always in the package. This invoice will also be available on the client’s web account (Section "My invoices" in the dashboard)
8.2 The date of exit from the warehouse is the date of issue of the invoice.
Article 9 : Payment
9.1 The price of the products is payable at the time of the order.
Article 10 : Return
10.1 The Customer has the possibility to return goods within 14 days of delivery of the order. Any returned product must be in its original packaging (in good condition) and be free of traces of use.
10.2 Any return must be the subject of a formal agreement between hygiene-precision and the Customer. Any return accepted by hygiene-precision will give rise, after qualitative and quantitative verification of the returned products, to the establishment of a credit. Any product returned without this agreement would be held at the disposal of the Customer and would not give rise to the establishment of a credit. Shipping costs, or any other related expenses will not be refunded in any case as a result of a return of goods. In the case of a return of large quantities of goods with a significant volume and/ or weight, hygiene-precision reserves the right to apply transport costs at the rate in force. Any additional costs for these returns will be communicated before the pick-up of the goods.
10.3 To make a return, the customer must use contact specifying the name of the product, the hygiene-precision reference and the quantity to be taken back.
10.4 The Customer must make the return himself. hygiene-precision.com is responsible for sending a return slip to be pasted on the package, the costs of return are the responsibility of the customer.
10.5 The returned goods must be in the condition in which the supplier delivered them (condition of the package, original packaging, intact warranty label, etc.) and accompanied by transport labels provided by hygiene-precision.
Items that are not returned in their original packaging or appear to have been used will not be accepted and refunded for hygiene reasons.
Article 11 : Reserve of ownership
11.1 The goods, subject to this contract, are sold with a clause expressly making the transfer of their ownership conditional on full payment of the price in principal and accessory.
11.2 The above provisions shall not prevent the transfer to the buyer of the risks of loss or damage of the goods subject to retention of title, as well as any damages which they may cause, from the delivery of the goods.
Article 12 : Dispute resolution
12.1 French law is the only applicable to the relations between the parties.
12.2 In case of dispute, the commercial court of is the only competent court.
